I’m moving to Barcelona mid-year: where do I pay tax?

Moving to Barcelona mid-year and unsure where you will be tax resident? Find out how your autonomous community is determined for personal income tax and what you need to do.

If you move to Barcelona halfway through the year, your autonomous community tax residence is not determined simply by the address you notify to the Spanish Tax Agency or where you are registered on the local census. If you are already tax resident in Spain, Law 22/2009 sets out a number of criteria for determining which autonomous community you must pay Personal Income Tax (IRPF) in for that tax year.

At Barcelona Tributario, we analyse the tax residence in Barcelona of individuals, business owners, investors and high-net-worth individuals who move to Catalonia from another autonomous community or from abroad. Our work is not limited to changing an address with the Spanish Tax Agency: we assess days spent in each location, income sources, assets, double tax treaties, and the effects on Personal Income Tax, Wealth Tax and, where applicable, the Temporary Solidarity Tax on Large Fortunes.

We want Barcelona Tributario to be Barcelona’s leading tax law firm for those who need to structure their move to the city correctly before an apparently straightforward decision leads to a subsequent tax assessment.

If you are going to establish your tax residence in Barcelona, we first review:

1. Whether you are tax resident in Spain during that year.

2. How many days you have spent in each autonomous community.

3. Where your main home is located and what documentation evidences your presence there.

4. Where your main centre of interests is located if the day-count criterion does not resolve the case.

5. What effect the move has on Personal Income Tax, Wealth Tax and large fortunes.

6. If you are arriving from abroad, what the applicable double tax treaty says.

7. Whether you can benefit from the special regime for inbound workers under Article 93 of the Personal Income Tax Act.

Tax residence in Spain and tax residence in Barcelona: they are not the same

Before determining your tax residence in Barcelona, we need to answer a prior question: are you tax resident in Spain?

Unsure about your tax residence this year because you are changing cities? Our tax lawyers analyse your specific circumstances and give you a clear answer before it is time to file your return.

Article 9 of the Personal Income Tax Act establishes, among other criteria, that an individual is habitually resident in Spain when they spend more than 183 days during the calendar year in Spanish territory, or when the main core or base of their activities or economic interests, directly or indirectly, is located in Spain.

The legislation also includes a presumption linked to the habitual residence in Spain of the spouse who is not legally separated and dependent minor children, unless proven otherwise.

Once residence in Spain has been established, we must determine which autonomous community you are considered resident in for the purposes of transferred taxes. This second issue is governed mainly by Article 28 of Law 22/2009.

How tax residence in Barcelona is determined if you move during the year

For Personal Income Tax, the legislation applies successive criteria. You cannot freely choose between Catalonia and your autonomous community of origin based on which has the more favourable tax treatment.

First criterion: where you spend the most days during the tax period

The main criterion is the autonomous community in whose territory you spend the greatest number of days during the tax period.

Law 22/2009 further establishes that temporary absences are counted when determining presence. Unless proven otherwise, an individual is deemed to remain in the autonomous community where their main home is located.

Example: moving to Barcelona on 1 July

In a non-leap year, if you live in your autonomous community of origin from 1 January to 30 June and effectively settle in Barcelona on 1 July, you will have spent 181 days in your place of origin and 184 days in Catalonia.

If there are no circumstances affecting that calculation, Catalonia will be your autonomous community of residence for that tax period.

Example: moving to Barcelona on 1 August

If you move on 1 August of a non-leap year, you will have spent 212 days in your autonomous community of origin and 153 days in Catalonia. In principle, the first criterion would mean that your autonomous community residence remains in your community of origin for that tax year.

Second criterion: the main centre of interests

If it is not possible to determine presence using the previous criterion, the law turns to the territory where the taxpayer’s main centre of interests is located.

Law 22/2009 does not use a general concept of “where you have more money”. It defines the criterion by reference to certain components of the Personal Income Tax taxable base:

  • Employment income: this is located where the relevant workplace is situated, if there is one.
  • Income from real estate capital and gains arising from property: these are located where the properties are situated.
  • Income from economic activities: this is located where the management centre for each activity is situated.

That is why, when we analyse the tax residence in Barcelona of a business owner or an individual with several sources of income, we reconstruct the origin and legal location of each relevant income stream before reaching a conclusion.

Third criterion: the last residence declared for Personal Income Tax purposes

Where residence cannot be determined either by presence or by the main centre of interests, Law 22/2009 refers to the place of the last residence declared for Personal Income Tax purposes.

This criterion is subsidiary. It does not mean that notifying an address to the Spanish Tax Agency allows you to choose the autonomous community. The reality of your residence prevails and must be capable of being evidenced.

What happens if there is a tie in the number of days?

A tie may arise, for example, in certain leap years. If the presence criterion does not determine the autonomous community, we must move to the second criterion: the main centre of interests.

In these cases, we do not recommend resolving the matter based on rough estimates. We review the exact dates, temporary absences and available documentation before deciding which community should be declared.

Is Personal Income Tax split between two communities if you move halfway through the year?

Under the ordinary Personal Income Tax regime, determining the autonomous community does not work as a monthly apportionment of regional tax rates.

Once the autonomous community of residence has been identified according to the legal connecting factors, the rules corresponding to that residence apply throughout the tax period.

This explains why a genuine move to Barcelona in the middle of the year can materially change the tax outcome for that year. Catalonia has its own regional tax scale and deductions, which must be reviewed for the specific tax year.

Registering on the local census in Barcelona is not enough

Registration on the municipal census can be relevant evidence, but it does not by itself determine tax residence.

To support a consistent tax residence in Barcelona, we normally analyse a combination of indicators and documents:

  • Tenancy agreement or title deed for the home.
  • The actual date you moved into the property.
  • Municipal census registration.
  • Utility consumption and supply contracts, where relevant.
  • Workplace.
  • Management centre of economic activities.
  • Children’s school enrolment, where applicable.
  • Documentation allowing actual presence to be reconstructed.
  • Any other lawful and relevant evidence to demonstrate the move.

There is no single document that alone resolves every case. The Spanish Tax Agency may assess all available circumstances together.

How to notify the Spanish Tax Agency of a change of tax address

Individuals who are not listed in the Register of Businesses, Professionals and Withholding Agents

Certain individuals may use Form 030 to notify a change of tax address.

The Spanish Tax Agency states that, as a general rule, the change must be notified within three months of its occurrence. If the deadline for filing the Personal Income Tax return due after the change ends before that period expires, the notification must be made in the income tax return itself.

Self-employed individuals and business owners: currently Form 036

If you are included in the Register of Businesses, Professionals and Withholding Agents, we must review the change using Form 036. The Spanish Tax Agency currently sets a general deadline of one month to notify a change of address in these cases.

The former Form 037 must no longer be filed: it was abolished with effect from 3 February 2025.

Changes of residence between communities with different tax treatment

Law 22/2009 contains specific rules for certain changes of residence whose main purpose is to achieve lower effective taxation in wholly or partially transferred taxes.

Moving to Barcelona halfway through the year can have tax consequences that are not always obvious. Avoid surprises from the Spanish Tax Agency and plan your position from day one with specialist support.

For this reason, we do not recommend setting an artificial date or building a residence position solely on formal documents. If the move to Barcelona is genuine, our role is to ensure it can be demonstrated and that all tax information is consistent with that reality.

What happens if you arrive in Barcelona from abroad

When the move is from Germany, the United Kingdom, France, the United States or another country, the analysis changes substantially.

It is no longer enough to determine the autonomous community. First, we must examine whether you become tax resident in Spain under Article 9 of the Personal Income Tax Act and whether you may simultaneously be considered resident in your country of origin under its domestic rules.

Where both States consider you resident, the applicable double tax treaty may contain tie-breaker rules that we need to analyse case by case.

The year of arrival can be particularly sensitive

Spain generally applies Personal Income Tax by calendar year. However, where there is an international situation, we must review the treaty rules, the timing of the move, income sources and obligations that may remain in the country of origin.

At Barcelona Tributario, we analyse these cases before returns are filed, because an incorrect conclusion may affect income obtained outside Spain, investments, company shareholdings or international assets.

The inbound workers regime or “Beckham Law” when moving to Barcelona

Certain taxpayers who acquire tax residence in Spain due to a move to Spanish territory may opt, provided they meet the requirements, for the special regime under Article 93 of the Personal Income Tax Act.

Since 2023, the regime has been extended to new profiles, including certain remote workers, entrepreneurs and highly qualified professionals, as well as certain family members in the cases provided for by law.

One of the general requirements is that you must not have been tax resident in Spain during the five tax periods preceding the one in which the move takes place.

For the portion of the taxable base subject to the regime’s specific general scale, the legislation currently applies 24% up to EUR 600,000 and 47% on the excess, without prejudice to the specific treatment of certain savings income.

It is important to state this correctly: a person benefiting from the regime remains a Personal Income Tax taxpayer, even though the tax is calculated by applying certain Non-Resident Income Tax rules.

Not everyone who moves, nor every investment, qualifies for the regime. Before recommending it, we verify the specific reason for the move and whether it falls within any of the cases in Article 93.

High-net-worth individuals establishing tax residence in Barcelona

For an individual with substantial assets, determining tax residence in Barcelona can have consequences that go far beyond the annual Personal Income Tax return.

At Barcelona Tributario, we review the following together:

  • Personal Income Tax.
  • Wealth Tax.
  • Temporary Solidarity Tax on Large Fortunes, where applicable.
  • Company shareholdings.
  • Possible family business exemption where its requirements are met.
  • Properties located in and outside Spain.
  • Financial portfolios.
  • International corporate structures.
  • Double tax treaties.
  • Applicable international reporting obligations.

Wealth Tax in Catalonia

Catalonia maintains its own Wealth Tax rules. For residents in Catalonia, the Catalan Tax Agency applies the regional rules in force for the relevant tax year.

The tax accrues on 31 December. Rather than using rates in this article that may change, at Barcelona Tributario we review the scale, exempt threshold, exemptions and filing obligations applicable to the specific year of the move.

Temporary Solidarity Tax on Large Fortunes

The Temporary Solidarity Tax on Large Fortunes remains applicable and has its own tax return form. For a high-net-worth individual planning to settle in Barcelona, we need to analyse its interaction with Wealth Tax as a whole.

Common mistakes when moving your residence to Barcelona

Believing that the municipal census determines tax residence

Census registration helps evidence facts, but it does not replace tax criteria.

Choosing the autonomous community with the most favourable tax treatment

The autonomous community is determined according to legal connecting factors. There is no voluntary choice between communities.

Still using Form 037

Form 037 was abolished with effect from 3 February 2025. Form 036 must now be used in the relevant cases.

Waiting until the income tax filing season to review substantial assets

Where companies, investments, real estate assets or international assets are involved, planning should take place before the move.

Thinking that benefiting from the Beckham Law means being non-resident

The taxpayer remains a Personal Income Tax taxpayer, even though they are taxed under the special rules provided for in Article 93.

Barcelona Tributario: tax lawyers for those moving to Barcelona

At Barcelona Tributario, we aim to become the leading tax law firm for those who live, invest or do business in Barcelona and need a legally robust tax structure.

We work particularly with situations where an error may have a material financial impact: international relocations, changes of autonomous community, business owners, company shareholders, investors, real estate assets and high-net-worth individuals.

We do not generically promise to “pay less tax”. Our role is to determine which rules apply to you, what legal alternatives exist, the tax cost of each option, and how the decision should be documented so it can be defended if the Spanish Tax Agency reviews it.

Frequently asked questions about tax residence in Barcelona

When do I have tax residence in Barcelona if I move halfway through the year?

If you are already resident in Spain, the first criterion for determining your autonomous community is where you spend the greatest number of days during the tax period. If that criterion does not determine it, the main centre of interests and then the last residence declared for Personal Income Tax purposes apply in succession.

Every move of residence is different, and the criteria for determining where you pay tax can catch you out if you do not understand them properly. Contact Barcelona Tributario and make sure you comply correctly from the outset.

Can I choose to pay tax in my previous autonomous community even if I live in Barcelona?

No. Autonomous community residence is determined by objective legal criteria. Notifying a different address or maintaining previous census registration does not allow you to choose the applicable regional rules.

If I move on 1 July, do I pay tax in Catalonia?

In a non-leap year, an individual who remained in their place of origin until 30 June and effectively moved to Catalonia on 1 July would, in principle, have spent more days in Catalonia. However, temporary absences and all other circumstances of the case must be checked.

Does municipal census registration by itself prove tax residence?

No. It is relevant evidence, but the Spanish Tax Agency may assess the home, presence, centre of interests and other evidence together. At Barcelona Tributario, we recommend building a documentary record that is consistent with the reality of the move.

Which form do I need to file to change my tax address?

Certain individuals who are not included in the Register of Businesses, Professionals and Withholding Agents may use Form 030. Business owners and professionals currently use Form 036 in the relevant cases; Form 037 was abolished from 3 February 2025.

What happens to my tax residence if I arrive in Barcelona from another country?

First, we must determine whether you become tax resident in Spain under the Personal Income Tax Act. If you are also considered resident by another State, we must review the applicable double tax treaty and its tie-breaker rules.

Can I apply the Beckham Law if I move to Barcelona?

It may be possible if you meet the conditions in Article 93 of the Personal Income Tax Act. Since 2023, it has been extended to certain new profiles, but not everyone who moves, nor every investment, qualifies for the regime. We must review the specific reason for the move.

Does residence in Catalonia affect Wealth Tax?

Yes. For residents, autonomous community residence is relevant to the application of Wealth Tax. For substantial assets, we also review the potential effect of the Temporary Solidarity Tax on Large Fortunes.

Can the Spanish Tax Agency challenge my change of residence?

Yes, if it considers that the facts do not match what has been declared, or if the specific rules provided for certain changes of residence apply. That is why we recommend documenting the genuine move from the outset.

When should I speak to a tax lawyer before moving?

The higher your income, assets or international complexity, the more important it is to review your position before the move. A company sale, a material capital gain, company shareholdings or international assets can completely change the analysis.

Can Barcelona Tributario plan my tax residence in Barcelona?

Yes. At Barcelona Tributario, we analyse Spanish and autonomous community residence, Personal Income Tax, assets, large fortunes, international treaties, the inbound workers regime and registration obligations to design a consistent and defensible tax transition.
