UK inheritance for Catalonia residents: taxes

Have you received an inheritance from the UK and live in Catalonia? Find out which taxes you must pay, how to avoid double taxation and what to do.

Receiving an inheritance from the UK in Catalonia requires coordination between two different tax systems. If the heir is a tax resident in Spain, they may be subject to Spanish Inheritance and Gift Tax on all assets received, even if they are located in London, Manchester, Scotland or anywhere else in the UK. At the same time, the deceased's estate may have been subject to UK Inheritance Tax.

At Barcelona Tributario, we specialise in international taxation and cross-border succession matters. We analyse the residence of the deceased and the heir, the competent authority, the applicable regional rules, the tax paid in the UK and the documentation required to avoid errors or double taxation.

Quick answer: if a person resident in Catalonia inherits from a deceased person who lived in the UK, they will normally need to consider Spanish Inheritance and Gift Tax under personal liability. If the deceased was not resident in Spain, the tax is administered by the AEAT, rather than the ATC, although Catalan rules may apply in certain cases. In addition, Spain and the UK currently do not have a specific inheritance double taxation treaty, so double taxation is primarily relieved through each country's domestic deductions and mechanisms.

Who must declare an inheritance from the UK in Catalonia

Heirs resident in Spain are taxed under personal liability

The Inheritance and Gift Tax Act establishes that individuals habitually resident in Spain are taxed under personal liability. This means they must include assets and rights acquired through inheritance regardless of where they are located.

Inheriting assets in the UK while residing in Catalonia may create tax obligations in two countries at the same time. Our tax lawyers assess your specific case and help you pay only the tax due, with no surprises.

Therefore, a property in London, a UK bank account, shares, funds or business interests may form part of the Spanish taxable base of an inheritance from the UK in Catalonia if the person receiving the assets is a tax resident in Spain.

The deceased's residence determines who administers the tax

If the deceased was not a tax resident in Spain, responsibility for administering Inheritance and Gift Tax lies with the AEAT's National Tax Management Office. This is particularly important because the fact that the heir lives in Barcelona does not automatically make the Agència Tributària de Catalunya the administering authority.

The applicable rules and the competent authority are two different matters. Although the tax may be administered at national level, there may be an entitlement to apply regional rules under the legally established connecting factors.

When Catalan rules may apply

If the deceased was non-resident and the heir lives in Spain, it may be possible to choose between national rules and the applicable regional rules. If there are assets in Spain, the relevant autonomous community is the one where the greatest value of those assets is concentrated. If there are no assets located in Spain, the rules of the autonomous community where the heir resides may apply.

Accordingly, an heir resident in Barcelona who receives exclusively UK assets may, in principle, choose Catalan rules even though the tax return must be filed with the AEAT.

What benefits may be available under Catalan rules

Relationship-based reductions

Where Catalan rules apply, the taxable base may be reduced depending on the relationship to the deceased. In 2026, a spouse or stable partner and children aged 21 or over are entitled to a reduction of €100,000; other descendants aged over 21, €50,000; and ascendants, €30,000.

Descendants under 21 are entitled to a reduction of €100,000 plus €12,000 for each year under 21, subject to the statutory limit.

Tax liability rebates

A spouse or stable partner may apply a 99 % rebate on the tax liability for transfers on death. Other taxpayers in Groups I and II have access to progressive rebates, the percentage of which depends on the taxable base.

For this reason, before settling an inheritance from the UK in Catalonia, we calculate whether applying Catalan rules is more favourable and how they interact with the double taxation deduction.

How UK Inheritance Tax works in 2026

The general threshold remains £325,000

For the UK tax year 2026-2027, the general nil-rate band remains at £325,000. The standard Inheritance Tax rate on the taxable part of the estate is 40 %, without prejudice to specific exemptions and reductions.

Residence nil-rate band of up to £175,000

An additional band of up to £175,000 may be available where a qualifying home is passed to direct descendants. This benefit begins to taper for net estates exceeding £2 million.

The available amount may be higher in certain cases involving spouses or civil partners where unused transferable bands are available, so we do not recommend automatically treating £500,000 as a universal “tax-free minimum”.

Long-term residence has mattered since April 2025

Since 6 April 2025, the UK has replaced the former domicile-based rules with a system focused on long-term residence. Exposure to IHT on assets located outside the UK may depend on whether the deceased met the long-term UK resident criteria.

Conversely, a person who does not fall within these rules may be subject to tax mainly on certain UK assets. This change makes the deceased's residence history one of the first documents we review.

Spain and the UK do not have an inheritance double taxation treaty

The 1975 treaty was not an inheritance treaty

The original text confused the former 1975 Spain-UK treaty with a specific inheritance treaty. That treaty covered taxes on income and capital and was replaced by the 2013 Convention currently in force for those matters.

HMRC's official list of treaties applicable to Inheritance Tax does not include Spain. Therefore, an inheritance from the UK in Catalonia should not be structured on the assumption that there is a specific bilateral treaty automatically allocating inheritance taxing rights between the two countries.

Spain applies the deduction under Article 23 of the Inheritance and Gift Tax Act

Where the heir is taxed in Spain under personal liability and has paid a similar tax abroad on the same assets, they may claim an international double taxation deduction.

The Spanish deduction is the lower of the tax actually paid abroad and the result of applying the effective average Spanish rate to the increase in wealth corresponding to assets or rights located or exercisable outside Spain that have been taxed abroad.

The UK also provides unilateral relief

HMRC provides Unilateral Relief mechanisms where the UK and a country with no specific treaty tax the same assets. The credit is subject to its own rules and limits. We must therefore coordinate the Spanish calculation with the treatment received by each asset in the UK tax return.

Deadline for filing the tax return and requesting an extension

Six months from the date of death

The general deadline for filing Inheritance and Gift Tax is six months from the date of death. In an international inheritance, this period may be tight because UK documentation, valuations and the probate process can take time.

The extension must be requested within the first five months

A single extension of a further six months may be requested, but it must be requested within five months of the death. The extension incurs late-payment interest for the relevant period.

Where the deceased was not resident in Spain and responsibility lies at national level, the application is processed through the AEAT under the non-resident Form 650 procedure.

Late filing surcharges are no longer between 5 % and 20 %

The current surcharge system for late filing without prior notice is 1 % plus a further 1 % for each full month of delay during the first 12 months. After that period, the surcharge rises to 15 % and late-payment interest begins to accrue under Article 27 of the General Tax Act.

Documentation, valuation and international civil-law matters

Spanish and UK documentation, valuation and exchange rates

For an inheritance from the UK in Catalonia, we usually review, among other documents, the death certificate, will, probate or estate administration documents, asset inventory, bank certificates, title deeds, valuations and evidence of IHT paid.

Where UK public documents are needed in Spain, they may need to be provided with an apostille and a sworn translation. The precise requirement depends on the document and the procedure in which it will be used. Assets must be valued in accordance with Inheritance and Gift Tax rules on the tax due date, and the conversion into euros should be documented using an official and consistent criterion applicable on the date of death. For property, unlisted companies, trusts or complex estates, we recommend preparing a specific valuation.

Brexit and the European Succession Regulation

The original text attributed the end of the application of the European Succession Regulation to the UK to Brexit. However, the UK did not participate in the adoption of Regulation 650/2012 and was never bound by it, even when it was a Member State of the European Union.

The Regulation also has universal application: the law designated by its rules may be that of a non-member state. Therefore, a Spanish authority required to decide civil-law succession matters may apply English, Scottish or other relevant UK law if the conflict rules lead to it.

This is separate from the tax treatment. At Barcelona Tributario, we always distinguish between which civil law governs the succession and which taxes must be paid, because they are different legal analyses.

How we manage an international inheritance at Barcelona Tributario

We first analyse residence, jurisdiction and applicable rules

Before calculating the tax liability for an inheritance from the UK in Catalonia, we determine the residence of the deceased, the residence of the heir, the location of the assets, the competent authority and the national or Catalan rules that may be used.

We coordinate Spain and the UK

We then review the Inheritance Tax return, the tax cost in Spain, the double taxation deduction, valuations and outstanding documents. Where necessary, we coordinate the matter with UK solicitors, executors or tax advisers.

Our aim is for the client to know, before filing, how much tax is due in each jurisdiction, what amount may be deducted and which documents must be retained in the event of a future tax inspection.

Frequently asked questions about inheritances from the UK in Catalonia

Where do I file the tax return if the deceased lived in the UK?

If the deceased was not a tax resident in Spain, the tax is administered by the AEAT. Although the heir lives in Catalonia, there may be an entitlement to choose Catalan rules according to the applicable connecting factors.

Every cross-border inheritance is unique and deadlines are short. Contact Barcelona Tributario today and avoid penalties, double taxation or the loss of tax rebates in Catalonia.

Is there an inheritance treaty between Spain and the UK?

There is currently no specific bilateral double taxation treaty applicable to UK Inheritance Tax and Spanish Inheritance and Gift Tax. Double taxation must be assessed under each country's domestic deduction or credit rules.

Can I deduct the Inheritance Tax paid in the UK in Spain?

There may be an entitlement to the international double taxation deduction under Article 23 of the Inheritance and Gift Tax Act, but the deductible amount is limited and does not necessarily equal all UK tax paid.

What is the deadline for filing the return?

The general deadline is six months from the date of death. An extension of a further six months may be requested within the first five months.

Did Brexit completely change the civil-law rules on succession?

Not in the way commonly claimed. The UK was already outside the European Succession Regulation before Brexit. Spanish authorities applying the Regulation may still designate UK law where its conflict rules lead to it.

What reductions can I apply if I live in Barcelona?

This will depend on whether Catalan rules apply. There are reductions for relationship, disability, the main residence, family businesses and other circumstances, as well as tax liability rebates for certain groups.

Do I need to wait until probate is completed before filing in Spain?

This should not be assumed. The Spanish tax deadline runs from the date of death. If UK documentation will not be available in time, it is advisable to assess as soon as possible whether to request an extension and which provisional documentation may be used.

Tell us which tax, official request or decision you need to assess and we will explain what information to prepare first.
